Welcome to Mojo Hospitality (Better Property Management LLC) (“Company,” “we,” “us,” or “our”). These Terms and Conditions govern the use of our property management services and communications, including SMS and phone interactions.
By using our services, you agree to these terms.
1. Services Provided
Mojo Hospitality (Better Property Management LLC) provides property management services, including but not limited to leasing, maintenance coordination, and tenant communications. These services may be provided through phone calls, emails, and SMS messaging.
2. Messaging and Communication Consent
By providing your phone number, you consent to receive text messages from Mojo Hospitality (Better Property Management LLC) regarding property updates, payment reminders, appointment scheduling, and other service-related communications.
Message Frequency & Charges
Message frequency may vary based on service needs.
Standard message and data rates may apply as per your mobile carrier’s plan.
3. Opt-In & Opt-Out
Opt-In: You opt into our SMS communications by providing your phone number during registration, leasing applications, or service requests.
Opt-Out: You can opt out of SMS communications at any time by replying STOP to any message. After opting out, you may receive a final confirmation message.

4. User Responsibilities
You agree to provide accurate and up-to-date contact information.
You will not use our services for unlawful or prohibited activities.
5. Privacy & Data Security

6. Disclaimers & Limitation of Liability
We are not responsible for any delays or failures in message delivery caused by mobile carriers or other third parties.
Our services are provided "as is" without any warranties, express or implied.
We are not liable for any damages resulting from the use or inability to use our services.
7. Changes to These Terms
We reserve the right to update these Terms and Conditions at any time. Continued use of our services after changes constitute your acceptance of the updated terms.

Rental Agreement, Credit Card Authorization, and Damage Waiver:
Reservations for this property are non-refundable, but we do offer a cancellation waiver that costs 10% of the gross rental fee and allows you to cancel within 48 hours prior to the check-in date. You may cancel for any reason up to 48 hours before check-in if you purchase this optional waiver at the time of booking. This can only be purchased at the time of the reservation. If you purchase this cancellation waiver, you must call and email us 48 hours before the check-in date with your notice of cancellation. If you cancel before the 48-hour window and you purchased this waiver, we will issue a refund check or credit the original credit card for the cost of the reservation (minus the cost of the waiver) within 5 to 7 business days. If this waiver was purchased, it will be reflected in the reservation breakdown below.
Damage Waiver and Capacity Restrictions:
Our properties are inspected before and after each reservation. Guests agree to pay for any flagrant damage to the units, excessive cleaning required at check-out, missing or damaged contents of the units, or any other accidental damage within the rental unit during the rental period. Your reservation was either charged $89.00 for a damage waiver covering up to $1,500.00 in damages or required a deposit. If any damages exceed this amount, the renter authorizes the cost of said damages or missing items to be charged to the credit card on file. The sleeping capacity for this property is limited to the number of beds provided: twin beds sleep one guest each; double, queen, and king beds sleep two guests each. Extra guests beyond the maximum sleeping capacity are not allowed without express written permission in advance. Often, extra sleeping capacity is not possible at this property. Each additional guest exceeding the maximum sleeping capacity will incur a charge of 10% of the nightly rental rate per guest, which will be charged to the credit card on file. No pets, smoking, or parties of any kind are allowed at this property.
RULES, REGULATIONS, & OTHER:
ALL PAYMENTS ARE NON-REFUNDABLE. If a reservation is canceled, all payments will be forfeited. A cancellation waiver is available for purchase. The cancellation waiver costs 10% of the gross rental fee and allows you to cancel within 48 hours prior to the check-in date. You may cancel for any reason up to 48 hours before check-in if you purchase this optional waiver at the time of booking, and we will refund the funds held for the reservation minus the cost of the waiver. This can only be purchased at the time of the reservation. If this waiver was purchased, it will be reflected in the reservation breakdown below.
Terms include a No Tolerance Policy regarding excessive noise, parties, or disturbing neighbors. Please ensure you are comfortable with our terms, as they are strictly enforced.
RESERVATIONS:
All reservations are subject to management and property owner approval. Online rates are subject to change without notice. Should there be any issues with the reservation, you will be contacted within 48 hours.
PROPERTY:
Guest rents, for vacation purposes only, the furnished real property and improvements described.
ARRIVAL & DEPARTURE:
Check-in time is no earlier than 4:00 PM on the arrival date. This time may be delayed due to unforeseen circumstances. Check-out time is no later than 11:00 AM on the departure date. Early check-in and late check-out options are available for an additional fee if available (not an option during peak times). If early check-in and/or late check-out are approved, you will receive an email confirmation from the reservation team.
PAYMENTS:
ALL PAYMENTS ARE NON-REFUNDABLE. Outside of 60 days before arrival, a deposit payment is due to reserve the property. The balance payment is due 60 days before arrival and will be charged automatically to the same credit card used unless communicated otherwise. Within 60 days of arrival, the total cost is due to reserve the property. ALL payments are NON-REFUNDABLE. We offer vacation rental insurance.
CANCELLATIONS & REFUNDS:
ALL PAYMENTS ARE NON-REFUNDABLE. If a reservation is canceled outside of 60 days before arrival, the deposit payment will be forfeited, and the guest is released from financial liability for the remaining balance. Cancellations with less than 60 days' notice will result in a 100% loss of all payments, less any security deposit or damage waiver. If we can replace the guest reservation and rebook the dates, we will credit 75% of the recouped rent toward a future reservation. This loss can be avoided if the cancellation waiver was purchased.
UNAVAILABILITY:
If, for any reason beyond management’s control, the premises become unavailable, management may substitute a comparable unit or cancel this agreement and refund all payments made by the guest in full.
STRICT NOISE ORDINANCE:
We have a strict noise ordinance that must be followed. No loud noises, music, or loud vehicles are allowed between 10:00 PM and 7:00 AM. Please note that failure to comply may result in fines and possible eviction.
APPROVED GUESTS AND USE:
The premises are for the sole use of approved guests as a personal vacation residence. The reserving guest is responsible for all guests who use the property during the rental term. The maximum occupancy for the property must not be exceeded.
OCCUPANCY:
Approved guests are the only individuals permitted to occupy the premises. No unlawful activity or activity constituting a nuisance is permitted. Guests take full responsibility for lost or broken items and any property damage.
SECURITY DEPOSIT:
A valid credit card must be kept on file upon reservation. If damages exceed the damage waiver coverage or deposit amount, the credit card on file will be charged for additional costs.
CLEANING:
The premises will be professionally cleaned before guest arrival. If excessive cleaning is required after check-out, additional charges may apply.
PETS:
Unauthorized pets are NOT allowed. If an unauthorized pet is discovered, the guest will be required to leave without a refund.
NO SMOKING:
No smoking is allowed on the premises. Violations may result in damage fees and/or immediate eviction.
MAIL SERVICES:
Guests may ship packages to the rental home via FedEx or UPS during their stay. However, we cannot guarantee delivery or security of packages. We are not responsible for lost, damaged, or delayed deliveries.
MAXIMUM OCCUPANCY:
No guests beyond the specified occupancy limit are allowed. Violations may result in immediate termination of the rental agreement without a refund.
NO PARTIES:
Our rentals are in residential areas and may not be used for weddings, receptions, parties, or large gatherings. Violations may result in eviction without a refund.
ILLEGAL SUBSTANCES:
No illegal substances are allowed. Minors may not be in possession of alcohol. Violations will result in eviction without a refund.
SYSTEM FAILURES & MAINTENANCE:
Management is not responsible for system failures such as water, plumbing, HVAC, or electricity malfunctions. Repairs will be made as soon as possible. No refunds will be given for such failures.
ENTRY:
Management reserves the right to enter the premises for repairs, inspections, emergencies, or showings with reasonable notice.
PARKING:
Winter parking laws must be followed. Vehicles parked illegally may be ticketed or towed at the owner’s expense.
TERMINATION OF OCCUPANCY:
Upon departure, guests must vacate the premises, return all keys, and leave the property in good condition.
WEATHER & NATURAL EVENTS:
No refunds will be issued for weather conditions, road closures, smoke from wildfires, or unforeseen events beyond management’s control. |
